Federal Judges' Panel: Costs and More Costs

Katzmann, and U.S. District Judge Victor Marrero spoke about the high cost of the justice system during an April 3 panel at Cardozo Law. 

 

The high cost of the justice system was the topic of discussion Monday night, when a panel of six federal judges visited Cardozo School of Law and focused their insights on Judge Victor Marrero’s “The Cost of Rules, the Rule of Costs,” published in the Cardozo Law Review last year.

The panel was sponsored by The Floersheimer Center, and included Southern District of New York Judges Richard M. Berman, John G. Koeltl, Loretta A. Preska, and Jed S. Rakoff. Chief Judge Robert A. Katzmann of the U.S. Court of Appeals for the 2nd Circuit served as moderator.

The panel debated the high cost of the country's legal system including attorneys' hourly rates, as well as the costs and issues generated by class action lawsuits and lengthy discovery processes.

Judge Preska noted that “class actions generate the most in useless costs…but class actions also bring big issues to light.” Judge Koeltl commented, “the costs of litigation are staggering.”
